Summary
A Brazilian living abroad chooses the power of attorney according to the act that will be carried out in Brazil. For a court case, the lawyer's power of attorney signed digitally is enough (Code of Civil Procedure, art. 105, § 1º), with no consulate involved. A public power of attorney is only required when the act itself requires a notarial deed (Civil Code, art. 657), such as out-of-court probate, out-of-court divorce and the sale of real estate. In those cases there are three routes: the Brazilian consulate (LINDB, art. 18), a notary in the country where the person lives with an apostille and sworn translation (Decree 8.660/2016), or e-Notariado, by video call (CNJ Provision 149/2023). Rocha Advogados, based in Goiânia (GO), Brazil, drafts the text of the power of attorney and points out the right route for each case of Brazilians living outside the country.
How do I make a power of attorney while living abroad?
The first step is knowing what the power of attorney (procuração) will be used for. Brazilian law requires different forms depending on the act. A court case accepts a document signed on a phone, while the sale of an apartment requires a deed at a notary's office (cartório). Rocha Advogados, a firm in Goiânia (GO) that serves Brazilians abroad, starts every case with that question. This way the client avoids booking a consulate appointment for nothing or signing a document the notary will reject.
When is the firm's digital power of attorney enough?
For any court case, the lawyer's power of attorney signed digitally is enough. The Code of Civil Procedure, art. 105, accepts a power of attorney for litigation in a private document signed by the party, and § 1º says it may be signed digitally. This applies to debt collection, court probate, contested divorce, claims against the INSS, labour claims and defence in enforcement proceedings. There is no consulate, apostille or notary along the way.
The same art. 105 requires a specific clause for some powers: to receive service of process, confess, settle, withdraw, waive the claim, receive payment, give a receipt and sign a declaration of financial hardship. That is why the firm's power of attorney already spells out those powers. Art. 105, § 4º, also says that the power of attorney granted at the start of the case is valid for all stages, including enforcement of the judgment.
When does the power of attorney have to be public?
A public power of attorney is required when the act the attorney-in-fact will perform requires a notarial deed. The Civil Code, art. 657, says that the grant of a mandate follows the form the law requires for the act. And art. 108 requires a public deed to transfer real rights over property worth more than 30 minimum wages. So anyone who will sell, buy or donate real estate through an attorney-in-fact needs a public power of attorney.
Out-of-court probate (inventário extrajudicial) follows the same logic. Resolution 35/2007 of the National Council of Justice (CNJ), art. 12, allows an heir to be represented by a public power of attorney with special powers. For an out-of-court divorce, the same resolution, in art. 36, requires a public power of attorney with special powers, the essential terms of the agreement and a validity of 30 days.
To have an INSS benefit received by someone else, Law 8.213/1991, art. 109, allows payment to an attorney-in-fact in case of absence, with a mandate of no more than 12 months, renewable. The INSS and the banks have their own forms and requirements, and the firm checks those rules before the client signs anything.
How do I make a power of attorney at the Brazilian consulate in Portugal, the US or London?
The Brazilian consulate issues a public power of attorney with the same value as a notary's office in Brazil. The Law of Introduction to the Norms of Brazilian Law (LINDB), art. 18, gives consular authorities jurisdiction over notarial acts for Brazilians. The request goes through the consulate's e-Consular system, with an appointment and in-person attendance, according to the Ministry of Foreign Affairs pages on gov.br.
The consulate usually asks for a photo ID and the CPF (Brazilian taxpayer number), plus the text of the powers already drafted. Each post, whether Lisbon, Porto, Miami, New York or London, has its own queue and requirements. The consular power of attorney is issued in Portuguese and needs no apostille. The Apostille Convention does not apply to documents issued by consular agents (Decree 8.660/2016, Convention, art. 1). For an uncontested divorce with no minor children, LINDB, art. 18, § 1º, allows the consulate itself to draw up the divorce deed.
Is a public power of attorney made abroad, before a local notary, valid in Brazil?
It is, provided it goes through three stages. The first is the Hague Apostille, enacted in Brazil by Decree 8.660/2016, which replaced the old consular legalisation. The apostille is issued by the authority of the country where the notary signed. Portugal, the United States and the United Kingdom are parties to the convention. If the country has not joined, the document goes through legalisation at the Brazilian consulate.
The second stage is a sworn translation, when the document is in a foreign language. The Civil Code, art. 224, requires translation into Portuguese for the document to have legal effect in Brazil. To file the document in a court case, the Code of Civil Procedure, art. 192, sole paragraph, requires a translation by a sworn translator or through diplomatic channels.
The third stage is registration at the Registry of Deeds and Documents (Registro de Títulos e Documentos). Law 6.015/1973, art. 129, item 6, requires registration of foreign documents that will have effect before public offices or in court. Art. 148 of the same law requires the translation to be registered and expressly mentions powers of attorney drawn up in a foreign language. In practice, this is the slowest of the three routes.
e-Notariado power of attorney: how do I do it from outside Brazil?
e-Notariado is the national platform of Brazilian notaries for electronic acts, governed by CNJ Provision 149/2023 (National Code of Rules), arts. 284 to 308. Under art. 284, sole paragraph, every notary in the country must offer the service. Art. 286 requires a recorded video call with the notary, the party's consent and a digital signature through e-Notariado itself.
The notary provides a notarised digital certificate free of charge for use on the platform, under art. 292, § 4º. Under art. 303, sole paragraph, the electronic public power of attorney falls to the notary of the grantor's domicile or of the property's location. Art. 304 requires proof of domicile through the voter registration card or another means and, without it, takes the property's location into account.
The provision does not forbid use by someone outside Brazil. The sensitive point is the notary's jurisdiction, so Rocha Advogados confirms with the notary's office before booking the video call. The fee follows the fee schedule of the state where the notary's office is located, and the office states the cost before drawing up the act.
What must the power of attorney say?
A general power of attorney only grants powers of administration. The Civil Code, art. 661, § 1º, requires special and express powers to sell, mortgage, settle or perform acts beyond ordinary administration. A power of attorney to sell property must say "sell" and identify the property by its title number (matrícula). It must also authorise receiving the price and giving a receipt.
The power of attorney also carries the full identification of the grantor and of the attorney-in-fact. That includes name, marital status, occupation, CPF, ID document and address. Married clients should remember the Civil Code, art. 1.647, item I: except under absolute separation of property, one spouse cannot sell real estate without the other's authorisation. In that case both sign the power of attorney or the spouse grants their own.
Does a power of attorney expire? How do I revoke it?
The law sets no general validity period. The Civil Code, art. 682, says that the mandate ends by revocation, by renunciation, by the death of either party or at the end of its term, when there is one. There are special periods: 30 days for an out-of-court divorce (CNJ Resolution 35/2007, art. 36) and 12 months for receiving an INSS benefit (Law 8.213/1991, art. 109).
In practice, the notary or the bank that will use the power of attorney usually asks for a recent certificate of it. To revoke it, the grantor signs a deed of revocation. CNJ Provision 149/2023, art. 272, § 4º, requires the notary who recorded the revocation to notify the notary who drew up the power of attorney. The Civil Code, art. 686, says that a revocation notified only to the attorney-in-fact does not affect third parties acting in good faith, so it is wise to notify the bank or the buyer as well.
Step by step to make the power of attorney while living abroad
- Tell the lawyer which act the power of attorney will allow: a court case, probate, divorce, a sale, INSS or a bank.
- If it is a court case, sign the firm's power of attorney digitally and stop here.
- If the act requires a deed, choose between the consulate, a local notary with apostille, or e-Notariado.
- Receive from the firm the finished text of the power of attorney, with the powers, the property's title number and the CPFs.
- Prepare a photo ID, a regular CPF and, if married, your spouse's details.
- Book the act on e-Consular, with the local notary or with the e-Notariado notary's office.
- With a local notary, obtain the apostille, the sworn translation and the registration at the Registry of Deeds and Documents.
- Send the firm the certified copy or the digital file, which the attorney-in-fact will present at the notary's office or the bank.
Which mistakes delay the power of attorney the most?
In the cases Rocha Advogados handles, the most common mistake is going to the consulate for a court case. The firm's digital power of attorney was enough. The second is making a power of attorney with general powers and finding out at the notary's office that it does not allow selling the property or receiving the price. The third is forgetting the spouse, who must authorise the sale under most property regimes.
Another frequent mistake is making a power of attorney before a foreign notary without knowing it still needs an apostille, a sworn translation and registration in Brazil. A suspended CPF or one with an outdated name also delays the case, because it blocks the deed. Finally, many people sign the divorce power of attorney too early and lose the 30-day window before the notary draws up the deed.
Frequently asked questions
Do I need to go to the consulate to file a case in Brazil?
No. For a court case, the lawyer's power of attorney signed digitally is enough (Code of Civil Procedure, art. 105, § 1º). The consulate only comes in when the act requires a public deed, such as out-of-court probate and divorce and the sale of real estate.
Does a power of attorney made at the consulate need an apostille or translation?
No. The power of attorney drawn up by the Brazilian consulate is issued in Portuguese and has the same value as a notary's office in Brazil (LINDB, art. 18). The Apostille Convention does not apply to documents issued by consular agents (Decree 8.660/2016, Convention, art. 1).
How much does a power of attorney through e-Notariado cost?
The fee follows the fee schedule of the state where the chosen notary's office is located. The notarised digital certificate used on the platform is free (CNJ Provision 149/2023, art. 292, § 4º). The notary's office states the cost before drawing up the power of attorney.
Is a power of attorney made at a notary in Portugal or the US valid in Brazil?
It is, with three precautions. The document needs the Hague Apostille (Decree 8.660/2016), a sworn translation if it is in another language (Civil Code, art. 224) and registration at the Registry of Deeds and Documents (Law 6.015/1973, arts. 129 and 148).
Can I sell my property in Brazil through a power of attorney?
Yes, with a public power of attorney granting special and express powers to sell (Civil Code, art. 661, § 1º). It must identify the property by its title number and authorise receiving the price and giving a receipt. If you are married, your spouse must also authorise the sale (Civil Code, art. 1.647, item I).
How long does it take for the power of attorney to be ready?
The firm's digital power of attorney can be signed on the same day the text is ready. At the consulate and on e-Notariado, the time depends on the post's or the notary's schedule. A foreign notary is the longest route, because of the apostille, the translation and the registration. The estimated timeline for your case is given in writing before we start.
